Terms of Service

1. Eligibility

You must be at least 18 years old to use RealViv. By using the Service, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. Your account

• You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
• You must provide accurate information during registration, including a real phone number you control, and keep it up to date.
• You may not create more than one account. Duplicate accounts may be terminated.
• You must notify us immediately at contact@realviv.com if you suspect unauthorized access to your account.
• We reserve the right to suspend or terminate your account at any time for violation of these Terms.

3. Acceptable use

You agree not to:

• Use RealViv for any unlawful purpose or in violation of any applicable local, state, national, or international law.
• Harass, abuse, threaten, stalk, or intimidate other users.
• Post or transmit content that is defamatory, obscene, pornographic, hateful, or promotes violence or discrimination.
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
• Upload content that infringes any third party's intellectual property, privacy, or other rights.
• Use the Service to send spam, unsolicited commercial messages, or automated messages.
• Attempt to reverse-engineer, decompile, disassemble, or otherwise derive source code from the Service.
• Scrape, crawl, or extract data from the Service by automated means.
• Use the Service in a way that could impair, overburden, or damage our infrastructure.
• Share your account credentials with any third party.
• Attempt to circumvent any safety, privacy, or blocking features of the Service.

4. User content

"User Content" means any information, photos, text, or other material you submit through the Service. You retain ownership of your User Content. By submitting User Content, you grant RealViv a worldwide, non-exclusive, royalty-free, sublicensable license to use, store, display, and distribute your User Content solely to operate and improve the Service.

You represent and warrant that:

• You own or have the necessary rights to your User Content.
• Your User Content does not violate any third party's rights.
• Your photos depict only yourself or people who have given explicit consent to appear on a dating app.

We reserve the right to remove any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.

5. Location services

Core features of RealViv require location access. By enabling these features, you consent to the collection and use of your location data as described in our Privacy Policy. You can revoke location access at any time in iOS Settings, but doing so will disable location-based features.

6. Blocking and reporting

RealViv provides blocking and reporting tools. You may block any user; blocks are enforced across the entire Service. You may report any user, photo, or message for harassment, abusive or threatening behavior, spam, or any other violation of these Terms.

We maintain zero tolerance for objectionable content and abusive behavior. We review every report and act on objectionable content within 24 hours by removing the content and ejecting the user who provided it. To report objectionable content or a user, use the in-app reporting tools or email us at contact@realviv.com.

Abuse of the reporting system is itself a violation of these Terms.

7. Subscriptions and billing

RealViv offers optional paid subscriptions that unlock additional features. These subscriptions are auto-renewable and are sold through your Apple App Store account. Payment is charged to that account when you confirm the purchase.

• Each subscription renews automatically for the same period unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your Apple App Store account is charged for renewal within the 24 hours before the end of the current period, at the price shown for your selected plan.
• You can manage your subscription, change your plan, or turn off auto-renew at any time in your device Settings, under your Apple ID, Subscriptions.
• Cancelling stops future renewals but does not refund the current period. Any unused portion of a free trial is forfeited when you purchase a subscription covering that period.

Purchases are processed by Apple, and refunds are handled by Apple in accordance with App Store policies. We do not process payments or issue refunds directly. If we change subscription prices, the new price will not apply until your next renewal, and we will notify you in advance where required by applicable law.

8. Intellectual property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of RealViv and its licensors. The RealViv name, logo, and marks may not be used without our prior written permission. You may not copy, modify, create derivative works of, or exploit any part of the Service without express written permission.

9. Third-party services

The Service integrates with third-party providers, including a cloud infrastructure provider, a push-notification service, an AI service used to generate activity suggestions, and an SMS provider. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices of these third parties.

10. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not conduct background checks on users. Meeting strangers carries inherent risk; please exercise appropriate caution.

11. Limitation of liability

To the maximum extent permitted by applicable law, RealViv and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from or relating to these Terms or the Service is limited to the amount you paid us in the twelve months preceding the claim, or USD $100, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless RealViv and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third party's rights.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service immediately ceases. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) will survive.

You may delete your account at any time in the app (Profile, Delete Account) or by contacting us at contact@realviv.com.

14. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property or confidentiality violations.

You waive any right to participate in a class-action lawsuit or class-wide arbitration.

15. Changes to these Terms

We may modify these Terms at any time. When we make material changes, we'll update the "last updated" date and notify you through the app or via push notification. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
